Manleys Solicitors settle cross-border business battle out of court

Manley’s Solicitors, a leading Chester law firm, are labelling their latest legal battle a success following their settlement of a commercial cross border litigation case out of court. Led by Peri Mornington, Dispute Resolution Specialist and Solicitor, Miss Mornington swiftly settled the jurisdictional dispute.
The Case

The dispute occurred after former business partners, unnamed for legal reasons, failed to translate a verbal agreement into a written one. This led to jurisdictional issues, with the firm’s legal opponent based in Northern Ireland, and no jurisdiction clause being agreed. Despite these complications, Peri Mornington secured £20,000 for her client.

The Complications

Whilst most business disputes are complicated by financial issues, cross- jurisdictional litigation cases present their own set of unique and time-consuming challenges. Defined as a business or company disagreement where a client is residing in a country separate to where the court is sitting, these cases rely on communication across separate jurisdictions.

When this happens, disagreements can escalate to legal proceedings.
